Terms of Service
1. What Tariff Spot is — and is not
Tariff Spot is a document preparation service. We generate completed CBP Form 19 protest packages and, by default, print and mail them to CBP on your behalf. We are not a customs broker, not a law firm, and not an importer’s authorised agent for purposes of 19 U.S.C. § 1641. The importer is the filer of record. We prepare the documents; the legal act of filing belongs to you.
Nothing in our service constitutes legal advice, customs brokerage, or a guarantee of any outcome before CBP or any court.
2. Eligibility
You must be at least 18 years old and have the legal authority to file a protest on behalf of the importer of record (i.e., you are the importer, consignee, surety on the import bond, or their duly authorised agent under 19 C.F.R. § 174.12). By using this service you represent that you meet these requirements.
3. Accounts
You are responsible for keeping your login credentials secure. You are responsible for all activity that occurs under your account. Notify us immediately at ask@tariffspot.com if you believe your account has been compromised.
4. Acceptable use
You agree to use this service only for legitimate CBP protest filings. You must not:
- Submit false or fraudulent entry information
- File protests you know to be frivolous or without legal basis
- Attempt to circumvent any security or access controls
- Resell or sub-license access to the service
5. Fees and payment
Fees are charged per entry filed at the rates displayed at the time of purchase. Fees are non-refundable once a protest has been submitted to CBP via our print-and-mail service or downloaded for ACE filing. If mailing fails due to a service error on our part, we will re-send at no additional charge.
6. Accuracy of information
You are responsible for the accuracy of all information you provide. We populate your Form 19 with the data you submit. We perform automated validation (entry number format, port code lookup) but we do not independently verify the legal merits of your protest grounds.
7. No guarantee of outcome
CBP has sole discretion over protest adjudication. We make no representation that any protest filed using our service will be approved, that any refund will be granted, or that any particular outcome will result. Past approval of similar protests by CBP does not predict future results.
8. Limitation of liability
To the maximum extent permitted by law, Tariff Spot’s total liability to you for any claim arising out of or relating to this service is limited to the fees you paid for the specific protest at issue. We are not liable for any indirect, incidental, consequential, or punitive damages, including lost refunds, missed deadlines caused by CBP, or errors in information you provided to us.
We are not liable for delays or failures caused by CBP’s systems, Lob’s mail delivery, or events outside our reasonable control.
9. Intellectual property
The CBP Form 19 template is a US government work in the public domain. The legal language templates, software, and all other original content produced by Tariff Spot are owned by Tariff Spot LLC and may not be reproduced or redistributed without permission.
10. Termination
We may suspend or terminate your account if you violate these terms. You may close your account at any time by emailing ask@tariffspot.com. Sections 7, 8, and 10 survive termination.
11. Governing law and disputes
These terms are governed by the laws of the State of Wyoming, without regard to conflict of law principles. Any dispute arising out of these terms or your use of this service shall be resolved in the state or federal courts located in Natrona County, Wyoming. You consent to personal jurisdiction in those courts.
12. Changes to these terms
We may update these terms at any time. Material changes will be communicated by email or by a notice on the site. Continued use of the service after changes constitutes acceptance.
